Terms and Conditions

These terms and conditions (the “Terms”) govern access to and use of elitexpression.com (the “Site”), as well as purchases made from Elitexpression 2014 Inc. (“EliteXpression,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to the Terms then in effect.

These Terms do not limit any mandatory rights granted to consumers under applicable laws, including Québec’s Consumer Protection Act.

2. Use of the Site

You agree to use the Site lawfully and not to interfere with its operation, security, or use by others. In particular, you must not attempt to gain unauthorized access, introduce malicious code, extract data on a large scale, or circumvent any security measure.

3. Customer Accounts

You are responsible for the accuracy of the information you provide, the confidentiality of your login credentials, and all activity carried out through your account. Please notify us promptly of any unauthorized use. We may suspend or close an account when we have reasonable grounds to believe that fraud, abuse, or a violation of these Terms has occurred.

4. Products, Services, and Information

We make reasonable efforts to provide accurate descriptions, images, colours, sizes, materials, specifications, and availability information. Displayed colours may vary by device, and slight variations may occur between products or fabric lots. If a material error occurs, we will notify you and provide the remedies required by law.

Size guides, recommendations, and fitting information are provided for guidance. Size selection remains based on the measurements and information supplied when the order is placed. The fit, appearance, and useful life of a garment may vary according to body shape, growth, use, care, and the discipline practised.

5. Orders and Formation of the Contract

Products displayed on the Site constitute an invitation to submit an order. After you place an order, we will send an electronic confirmation that can be retained and printed. An order may be refused or cancelled for a legitimate reason, including unavailability, an obvious error, a payment issue, a risk of fraud, or a delivery restriction. If payment has already been collected for a cancelled order, it will be refunded to the original payment method, subject to applicable law.

6. Prices, Taxes, and Payment

Unless otherwise indicated, prices are in Canadian dollars and exclude taxes, shipping charges, customs duties, and any other applicable fees. The total amount payable is shown before the order is completed. Prices and promotions may change without notice, but the price confirmed in an accepted order will remain applicable, except in the case of an obvious error addressed in accordance with the law.

Full payment is required using one of the payment options offered at checkout. Transactions are processed by authorized payment service providers and may be subject to security checks.

7. Availability

Displayed inventory levels may change quickly. If an ordered item becomes unavailable, we will contact you to offer, as appropriate, a revised timeline, a substitute, or cancellation and a refund for the affected item. We may limit purchase quantities when reasonably justified.

8. Shipping and Delivery

Orders are delivered to the address provided at checkout. You are responsible for ensuring that the address is complete and accurate. Shipping charges, available options, service areas, free-shipping thresholds, handling charges, and estimated delivery times are shown at checkout or in our Shipping Policy. Delivery times are estimates unless expressly stated otherwise.

International orders may be subject to customs duties, taxes, brokerage fees, and customs formalities imposed by the destination country. Unless otherwise indicated, these amounts are the recipient’s responsibility. Your rights in the event of delay or non-delivery remain those provided by applicable law.

9. Returns, Exchanges, and Refunds

Online purchases may be returned for an exchange or refund within 30 days of the shipping date, in accordance with our Return Policy. Items must be unworn, unaltered, unwashed, and accompanied by their tags and proof of purchase. For swimwear, hygienic liners must remain in place. Exclusions may apply to personalized, modified, or custom-made products when clearly disclosed before purchase and permitted by law.

Return shipping costs are normally the customer’s responsibility, and return shipping charges are non-refundable, except where an item is damaged, defective, or incorrect, or where the law provides otherwise. International returns must be identified as returns and accompanied by the required customs documents. The Return Policy posted on the Site forms part of these Terms. In the event of a conflict, mandatory rights under applicable law prevail.

10. Legal Warranties and Manufacturer Warranties

Products sold are covered by applicable legal warranties. They must be fit for their normal purpose for a reasonable period of time, taking into account, among other things, the price, the contract, and the conditions of use. Manufacturers may offer additional warranties, which are subject to their own terms. Nothing in these Terms excludes or limits a legal warranty that cannot lawfully be excluded.

11. Custom Products and Sewing Workshop Services

Personalized or custom-made products are produced according to the measurements, sizes, design choices, and other information provided when the order is placed. The price, deposit, estimated timeline, number of included alterations, and applicable cancellation or return conditions are communicated before the order is accepted. Any change requested after design approval or the start of production may result in additional charges or delays, with your consent where required.

12. Intellectual Property

The Site and its content, including text, photographs, patterns, designs, graphics, logos, videos, layouts, and brand elements, belong to EliteXpression, its affiliates, or their respective owners and are protected by applicable laws. You are granted a limited, personal, revocable, and non-transferable licence to view the Site and make purchases. Any unauthorized reproduction, modification, distribution, or exploitation is prohibited.

13. Third-Party Trademarks and External Links

Trademarks and content belonging to manufacturers or other third parties remain the property of their respective owners. The Site may contain links to external services. We do not control their content, terms, or practices and are not responsible for them, subject to applicable law.

14. User-Submitted Content

If you post a review, photograph, comment, or other content, you confirm that you have the right to do so and that the content does not infringe the rights of others. You grant us a non-exclusive licence to use that content solely to the extent necessary to operate and reasonably promote our services. We may remove content that is unlawful, misleading, abusive, or contrary to these Terms.

15. Site Availability and Limitation of Liability

We seek to keep the Site accessible and secure, but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we are not liable for indirect or unforeseeable losses arising from an interruption, an event beyond our reasonable control, or improper use of the Site. This clause does not limit any liability or remedy that cannot be excluded under applicable law.

16. Privacy

Our collection and handling of personal information are described in our Privacy Policy, which forms part of these Terms.

17. Changes to These Terms

We may amend these Terms to reflect changes in our activities, the Site, or applicable laws. The revised version and its effective date will be posted on the Site. Changes apply prospectively and will not retroactively alter an order already concluded, except where permitted by law or with your consent.

18. Governing Law and Disputes

These Terms are governed by the laws of Québec and the federal laws of Canada applicable in Québec. Any dispute will be submitted to the courts having jurisdiction in accordance with mandatory rules, including those protecting consumers. Before initiating proceedings, the parties are encouraged to attempt to resolve the matter in good faith by contacting customer service.

19. General Provisions

If any provision is found to be invalid or unenforceable, the remaining provisions will continue in effect. A failure to exercise a right immediately does not constitute a waiver. These Terms, together with the policies they reference and the information confirmed for an order, constitute the agreement applicable to use of the Site and the relevant purchase.
